Terms of Service

These Terms of Service ("Terms") form a binding agreement between you and Alpha Stream Marketing ("Yoni", "we", "us", or "our") governing your use of the Yoni coaching platform, our website at https://coaching.alphastreammarketing.com, and related services (collectively, the "Service").
Please read these Terms carefully, especially Section 9 (Health Disclaimer) and Section 11 (Limitation of Liability).
1. Acceptance of these Terms
By creating an account, accessing, or using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization.
You must be at least 16 years old to use the Service.
2. Description of the Service
Yoni is a coach–client fitness coaching platform. It provides tools for coaches to:
- Manage clients and a client roster.
- Build and assign training programs.
- Set nutrition targets (macros) and meal plans.
- Exchange 1:1 messages with clients.
- Track client progress through metrics, logs, photos, and check-ins.
Clients use the Service to follow assigned programs, log workouts, record nutrition and progress, and communicate with their coach. The Service may include optional AI-assisted features (for example, analyzing meal photos or descriptions); see Section 9.
Yoni is a software tool. We are not a party to the coaching relationship between a coach and a client (see Section 5).
3. Accounts and roles
The Service supports two primary roles:
- Coach — holds a paid or trial account, manages clients, and is responsible for the coaching content they create and assign.
- Client — invited by a coach; uses the Service to follow programs and communicate.
You agree to:
- Provide accurate account information and keep it current.
- Keep your login credentials confidential and secure.
- Be responsible for all activity under your account.
- Notify us promptly at vas@alphastreammarketing.com of any unauthorized use.
We may suspend or terminate accounts that violate these Terms (see Section 12).
4. Acceptable use
You agree not to:
- Use the Service for any unlawful, harmful, or fraudulent purpose.
- Upload content you do not have the right to share, or that is illegal, abusive, harassing, or infringing.
- Upload another person's photos or personal/health data without their consent.
- Attempt to access accounts or data that are not yours.
- Probe, scan, reverse engineer, or disrupt the Service or its infrastructure.
- Use the Service to provide medical diagnosis or treatment, or to practice a regulated profession without proper qualification and licensing.
- Resell, sublicense, or misuse the Service or its AI features.
We may remove content or restrict access that we reasonably believe violates these Terms or applicable law.
5. The coach–client relationship
Coaching services are provided directly by the coach to the client. Yoni provides the platform only and is not a party to, and does not supervise, endorse, or guarantee, any coaching relationship, program, advice, or outcome.
- Coaches are solely responsible for the programs, nutrition plans, advice, and communications they deliver, and for holding any qualifications, licenses, insurance, and legal bases required to provide their services and to process client data. As controller of their client data, a coach must: give their clients their own privacy notice; maintain a valid legal basis and, for health data, valid explicit consent; handle their clients' data-subject requests (we will assist); use the AI and notification features lawfully; and only onboard clients who meet the minimum age and whose data they are entitled to process.
- Data processing. Where we process a coach's client data on the coach's behalf, the coach acts as the data controller and we act as a data processor. That processing is governed by our Data Processing Agreement (DPA), which is incorporated into these Terms by reference; by using the Service to manage clients, the coach agrees to the DPA.
- Clients are responsible for evaluating whether a program is appropriate for them and for consulting a qualified professional where appropriate (see Section 9).
Disputes between coaches and clients are between those parties. Yoni is not responsible for resolving them.
6. Payments and subscriptions
- The Service is offered to coaches on a subscription basis, with one or more pricing tiers. Clients are not charged by Yoni for using the Service as invited by a coach (a coach's own fees to their clients are separate and outside these Terms).
- Fees, billing cycles, and tier features are described at point of purchase or on https://coaching.alphastreammarketing.com. Payments are processed by Stripe; by subscribing you also agree to Stripe's terms.
- Subscriptions renew automatically each billing period unless cancelled before renewal. You can cancel at any time; cancellation takes effect at the end of the current period.
- Except where required by law, fees are non-refundable. We may change pricing prospectively with reasonable notice.
- EU consumer right of withdrawal. If you subscribe as a consumer in the EU, you have a statutory 14-day right of withdrawal for distance contracts. Because the Service is digital content/services supplied immediately, by starting to use the Service within that period you expressly request immediate performance and acknowledge you lose the right of withdrawal once the Service has been fully provided. This does not affect any non-waivable consumer rights.
- You are responsible for any applicable taxes.
7. Intellectual property
The Service, including its software, design, and branding, is owned by Alpha Stream Marketing and its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms. You may not copy, modify, distribute, or create derivative works of the Service except as expressly permitted.
"Yoni" and our logos are our trademarks and may not be used without permission.
8. User content
"User Content" means anything you submit to the Service, including progress photos, food photos, workout logs, check-in notes, messages, and the training and nutrition programs created by coaches.
- You retain ownership of your User Content.
- You grant us a limited, worldwide, non-exclusive license to host, store, process, transmit, and display your User Content solely to operate and provide the Service (including via the sub-processors and AI features described in our Privacy Policy).
- You are responsible for your User Content and represent that you have the rights and consents needed to submit it.
- We may remove User Content that violates these Terms or the law.
9. Health disclaimer (please read)
Yoni is a software tool, not a healthcare provider, medical device, or substitute for professional medical advice.
- Information and features in the Service — including programs, nutrition targets, progress analytics, and AI-generated suggestions — are for general fitness and informational purposes only.
- The Service does not provide medical advice, diagnosis, or treatment. AI features (such as meal photo or description analysis) may be inaccurate and must not be relied upon for medical or nutritional decisions.
- Always consult a qualified physician or healthcare professional before starting any exercise or nutrition program, particularly if you have a medical condition, are pregnant, or have concerns about your health.
- You use programs, advice, and features at your own risk. Physical activity carries inherent risks, including injury.
If you experience a medical emergency, call your local emergency services immediately.
10. Disclaimers
To the maximum extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted or error-free operation. We do not warrant any particular fitness, health, or business outcome from using the Service.
11. Limitation of liability
To the maximum extent permitted by law:
- Yoni and its officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or business, arising out of or related to your use of (or inability to use) the Service.
- Yoni will not be liable for any injury, health outcome, or loss resulting from programs, nutrition plans, advice, or AI output delivered through the Service, which are the responsibility of the relevant coach and the user (see Sections 5 and 9).
- Our total aggregate liability for all claims relating to the Service will not exceed the greater of (a) the amounts you paid us for the Service in the 12 months before the event giving rise to the claim, or (b) the price shown at checkout (EUR).
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law — including death or personal injury caused by negligence, fraud or fraudulent misrepresentation, intent or gross negligence, liability under applicable data-protection law (including the GDPR), and your non-waivable statutory rights as a consumer. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
12. Termination
- You may stop using the Service and delete your account at any time from within the Service.
- We may suspend or terminate your access if you breach these Terms, if required by law, or if necessary to protect the Service or other users.
- On termination, your right to use the Service ends. Sections that by their nature should survive (including ownership, disclaimers, limitation of liability, and governing law) will survive.
- You can export your data (JSON) and erase your account and data from within the Service, as described in our Privacy Policy.
13. Governing law and disputes
These Terms are governed by the laws of the Netherlands, without regard to conflict-of-laws rules. The courts of the Netherlands will have exclusive jurisdiction over any dispute, except where mandatory consumer-protection law gives you the right to bring proceedings in your country of residence.
If you are a consumer in the EU, you may be entitled to use alternative dispute resolution (ADR). The European Commission's Online Dispute Resolution (ODR) platform was discontinued on 20 July 2025 and is no longer available; for out-of-court redress, contact a competent consumer/ADR body in your country of residence (in the Netherlands, e.g. the relevant geschillencommissie). Nothing in these Terms limits your mandatory statutory rights as a consumer, and the choice of law above does not remove the supervisory jurisdiction of the Autoriteit Persoonsgegevens over data-protection matters.
14. Changes to these Terms
We may update these Terms from time to time. We will post the updated version with a new "Last updated" date and, for material changes, provide reasonable notice. Continued use of the Service after changes take effect means you accept the revised Terms.
